How to Remove a Bankruptcy From Credit Report

Question: Can you give me the specifics on how to remove a bankruptcy from credit report?

Answer: This blog post is going to be completely different than every other blog about how to remove a bankruptcy from credit report.

Let me begin with one assumption: Your bankruptcy is legitimate, meaning that you are not some victim of identity theft whereby the bankruptcy on your credit report belongs to someone else.

With that assumption, here is my answer: You cannot get it removed, and you should not worry about getting it removed. Let me explain.

1)     You don’t need to learn how to remove a bankruptcy from credit report. Most people think that after bankruptcy, your credit is ruined for seven years.  That is simply not true.  If you reestablish your credit properly after bankruptcy, you can have a 720 Credit Score in just two years after the bankruptcy.

2)    If you go through the process of finding out how to remove a bankruptcy from credit report, you will run into lots of unscrupulous organizations who will charge you to have the bankruptcy removed. The organizations that tell you that they can remove a bankruptcy from your credit report often offer a “100% money back guarantee.” The truth is that you won’t be able to get your money back. There are no legal ways to remove a legitimate bankruptcy from your credit report, so save you money and avoid these scams.

3)     That’s right, it is illegal. According to the FTC, it’s illegal to get an item off your credit report that is correct.  Read For Yourself.

Here is the one simple solution that works every time:  Reestablish your credit after a bankruptcy the same way you established credit the first time.  Just start now, don’t wait even one day.

Learning how to fix credit is simple, just keep in mind that it’s going to take you between 18-24 months to get a credit score over 720 assuming you do it the right way.  The biggest mistake people make is wiping their hands of all credit.

    Yes you can remove bankruptcy records from your reports and I have it done successfully. The law requires removal of any unverifiable information from your report regardless of its correctness. If bankruptcy (for whatever reasons) cannot be verified, it must be removed. Nothing on the FTC site states that it is illegal to remove a correct item from your report. It only states that it is illegal to make promises that cannot be fulfilled (fraud).

    Here is the deal: I have investigated this issue with two attorneys who advise me that there is no LAW which requires the listing of a bankruptcy on an individual’s credit report. While this may be the corporate policy of the money-grubbing credit reporting companies, it is not, in fact, the law. Thus, these corporations’ policies are moot. Credit reporting agencies are for-profit corporations – they are not government agencies and, thus, they cannot dictate laws nor mandate the reporting of public record information. As an example: divorce, births, lawsuits, voter registration, and criminal records are all public record, but these companies do not report these data. Using this policy as precedent, there is no basis for purposefully seeking and reporting certain public record information and not all public information. I hope people will contact their legislators to support legislation providing “bankruptcy amnesty” – a new movement to help those who were so severely impacted by the 2008 recession. Bankruptcy amnesty would enable anyone who filed for bankruptcy between 2008 and December 31, 2011 to request that their bankruptcy NOT appear on their credit reports.

    By helping people who are trying desperately to rebuild their lives and their credit, we must work together to fight big corporations who are in cahoots with lenders. Consumers with bankruptcies on their reports are charged higher interest rates and often denied credit altogether. How is this supposed to help our economy??? With interest rates at a phenomenal low, good people who are re-establishing themselves cannot get loans. Who is scooping up these properties and taking advantage of the great interest rates? The RICH! What our government is doing is essentially eliminating the middle class – making the poor poorer and the rich richer.

    Let’s help good, decent Americans restore their credit and stop punishing them for TEN YEARS for mistakes the government and the mortgage companies made. What’s right is right.
